Tidal wetland permits (except for maintenance and new dredging projects) are limited to a maximum five-year term, with extensions requiring submission of a complete new application for department review.

Department must consider short and long-term tidal wetland migration pathways, sea level rise, and coastal flooding from extreme weather events when granting, denying, or limiting permits.

Department may be required to promulgate rules and regulations regarding climate change and coastal hazard criteria for permit decisions.

Permits inactive for three years must be re-evaluated by the department regarding project terms, conditions, location, and scope before applicant can proceed, applying all criteria in the law.
