Clarifies that when a pediatric provider performs maternal depression screening, the child is the patient and the service is covered under the child's health plan, not the mother's.

Permits patients to access maternal depression screening and referral directly from obstetrical, gynecologic, or pediatric providers of their choice, subject to standard health plan terms and conditions.

Amends Public Health Law Section 4406-f and Insurance Law Sections 3217-g and 4306-f to establish that no HMO, insurer, or health corporation shall limit access to maternal depression screening based on provider network status when the screening is provided by a pediatric provider.

Specifies that when maternal depression screening is performed by a non-pediatric provider, the mother is the patient and the service is provided to the mother.

Takes effect January 1 following enactment and applies to all policies and contracts issued, renewed, or modified on or after that date.
