Amends the definition of "smoking" in public health law to include the use of electronic cigarettes, bringing e-cigarettes under existing smoking restrictions in public areas.

Defines "electronic cigarette" or "e-cigarette" by reference to existing definitions in Public Health Law Section 1399-aa.

Creates a new definition of "retail electronic cigarette store" as a retail store devoted primarily to selling electronic cigarettes, where other product sales generate less than 25 percent of total annual gross sales.

Establishes an exemption allowing retail electronic cigarette stores to permit use of electronic cigarettes within their premises, despite general smoking restrictions.

Takes effect thirty days after enactment, with immediate authorization for agencies to promulgate necessary rules and regulations.
