Grants Eric Zausner tier IV status in the New York state and local employees' retirement system retroactive to June 25, 2003, despite currently holding tier V status.

Requires Zausner to file a written request with the state comptroller within one year of the act's effective date to claim tier IV status with all associated rights and benefits.

Establishes that Zausner's prior continuous part-time employment with the Nassau County Board of Elections from June 25, 2003 to July 6, 2005 counts toward retirement system membership, notwithstanding his failure to enroll due to circumstances beyond his negligence.

Prohibits refunding any contributions Zausner has made to the retirement system and requires Nassau County to bear all past service costs associated with implementing this act.

Takes effect immediately upon enactment.
