Requires all heating oil sold for use in New York buildings to contain at least 2% biodiesel once in-state biodiesel production reaches 12 million gallons annually for three consecutive months.

Increases the biodiesel blend requirement to at least 5% once in-state biodiesel production reaches 30 million gallons annually for three consecutive months, with blending requirements taking effect 180 days after certification by the New York Energy Research and Development Authority.

Defines biodiesel feedstock to include soybean oil, algal oil, biogenic waste oils, fats, greases, and non-food grade corn oil, with commissioner authority to modify based on federal regulations in 40 C.F.R. § 80.1426.

Allows the governor to temporarily suspend the biodiesel requirements by executive order if adequate biodiesel supply is unavailable or compliance would cause undue financial hardship to consumers.

Permits higher biodiesel blends and does not preempt New York City laws that mandate equal or greater percentages of biodiesel in heating oil.
