Clarifies that when a pediatric provider conducts maternal depression screening, the child is deemed the patient and the screening is a service to the child, allowing coverage based on the child's health plan network rather than the mother's.

Removes requirement for pediatric providers to create a new patient record for the mother when performing maternal depression screenings.

Amends Public Health Law § 4406-f and Insurance Law §§ 3217-g and 4306-f to apply these clarifications to HMOs, insurers, and health corporations that provide coverage for maternal depression screening.

Maintains that when a mother's own healthcare provider performs the screening, the mother remains the patient and the screening is a service to the mother.

Takes effect January 1st following enactment and applies to all policies and contracts issued, renewed, or modified on or after that date.
