Establishes a transplant council within the department composed of 21 members appointed by the governor (7), senate president (7), and assembly speaker (7) to advise and make recommendations to the commissioner on organ donation, procurement, transplantation, and related issues.

Requires council members to include representatives from the general public, transplant recipients and donors, organ procurement organizations, tissue banks, physicians with transplantation expertise, and professionals in histocompatibility typing, law, and ethics.

Mandates the council make recommendations annually to the commissioner regarding state regulation of organ donation and procurement organizations, tissue banks, and transplantation activities.

Requires the commissioner to submit any modified proposed rules and regulations relating to organ donation, procurement, and transplantation to the council for review and provide written explanation if declining to promulgate rules as proposed.

Sets council member terms at three years with a majority of appointed voting members constituting a quorum, meeting at least twice annually, and receiving no compensation but reimbursement for necessary expenses.
