Governor shall convene a nine-member work group to study and make recommendations regarding appropriate payment of supplements to construction workers using the annualization methodology from the federal Davis-Bacon Act.

Work group shall examine the impact of prohibiting persons or entities that have violated Davis-Bacon Act obligations from bidding on or being awarded public works contracts with the state, municipalities, public benefit corporations, or public bodies.

Work group membership includes one appointee each from the governor, senate temporary president, and assembly speaker; one from the commissioner of labor; one from Empire State Development Corporation; two labor organization representatives; and two contractor association representatives.

All appointments must be made by August 1, 2016, with failure to appoint resulting in forfeiture of appointment rights.

Work group shall issue recommendations to the governor and legislative leaders by February 1, 2017; act takes effect immediately upon passage.
