Council on the Arts prohibited from awarding grants to organizations unless they are incorporated in New York or, if incorporated elsewhere, are registered to do business in the state with principal place of business located within New York.

Organizations applying for grants must provide documentation demonstrating compliance with residency and business location requirements, valid for two years or until organizational status changes.

Out-of-state incorporated organizations registered to do business in New York must certify in their grant application that their principal place of business is located within the state.

Applicants must demonstrate in their grant application materials that awarded funds will be used toward programs in New York State or be deemed ineligible for funding.

Applicants failing to provide required documentation or certifications are deemed ineligible to receive grant funding under the article.
