Requires the commissioner of health and commissioner of developmental disabilities to develop a statewide, uniform, and transparent process for assigning out-of-home residential placements for developmentally disabled persons on a priority basis.

Establishes three criteria for prioritizing placements: extent of individual's disability using uniform assessment methodology; nature of living situation including age and health of family caregivers and their ability to continue providing care; and priority one status under the state's home and community based services waiver.

Prohibits automatic designation of priority one status based solely on membership in a "special population," but allows developmental disabilities regional offices to refer "special population" members meeting priority one criteria during emergencies for provider evaluation and placement.

Mandates the department consult with the office for people with developmental disabilities to seek necessary amendments to the state's home and community based services waiver application to implement this act.

Requires implementation within 120 days of the act's effective date.
