Prohibits residential health care facilities from including mandatory arbitration clauses in contracts with residents or their representatives.

Defines "mandatory arbitration clause" as a contract provision requiring parties to submit disputes to arbitration before pursuing legal action to enforce the contract.

Defines "arbitration" as a decision-making process conducted by an arbitrator or panel of arbitrators under Article 75 of the Civil Practice Law and Rules.

Takes effect immediately upon enactment.
