Governor must submit five-year capital plans for SUNY state-operated campuses and CUNY senior colleges to the legislature as part of the annual executive budget starting in fiscal year 2019 and every fifth fiscal year thereafter.

Capital plans shall provide annual appropriations to cover 100 percent of critical maintenance needs identified by each university system.

Plans may include funding for new infrastructure or major capital initiatives, but such funding does not count toward meeting the critical maintenance requirement.

If budget limitations prevent funding 100 percent of critical maintenance needs, the director of the budget shall develop plans that annually reduce the facility condition index (FCI) for each university system.

Director of the budget shall develop the apportionment methodology for capital appropriations to each campus or college in consultation with SUNY and CUNY.
