Funeral directors licensed under Article 34 of the Public Health Law are presumed to have passed all required examinations for the 2018-2020 biennial renewal registration and any subsequent renewals.

The presumption applies regardless of any adverse examination score actions that occurred after the initial licensure application was approved.

The presumption may be overcome only if the Commissioner of Health determines, after providing notice and opportunity to be heard, that the applicant violates paragraph (c) of Section 3450 of the Public Health Law.

The act takes effect immediately upon enactment.
