Amends Vehicle and Traffic Law section 1225-d to expand the definition of "using" a portable electronic device to include inputting information into music apps or GPS-based navigation apps, and viewing or transmitting videos.

Clarifies that "using" a device does not include operating it by voice command system that requires no physical touching.

Adds exemption allowing use of portable electronic devices by operators of legally parked vehicles.

Creates separate penalty structure for violations occurring while temporarily stationary (stopped at traffic lights, stop signs, railroad crossings, or other traffic control devices): $50 fine and 1 point for first violation, $100 fine and 2 points for second violation within 18 months, and $150 fine and 3 points for third or subsequent violation within 18 months.

Maintains existing penalties for violations while operating a moving vehicle: $50-$200 for first violation, $50-$250 for second violation within 18 months, and $50-$450 for third or subsequent violation within 18 months.
