Allows individuals convicted of criminal possession of marijuana in the fifth degree to petition for expungement of their conviction records after two years from conviction and completion of probation, parole, supervised release, and payment of fines or restitution.

Requires petitioners to have no prior or subsequent convictions in New York, another state, or by the United States to be eligible for expungement.

Mandates service of expungement petitions on the district attorney, state police superintendent, local police department, and sentencing judge or supervising judge in the jurisdiction.

Allows courts to grant expungement orders within 90 days if no objections are filed by law enforcement agencies and the petitioner meets all eligibility requirements, directing all relevant agencies to expunge arrest, detention, conviction, and sentencing records.

Applies retroactively to convictions that occurred before the effective date of the legislation as well as future convictions.
