Requires all motor carriers to conduct pre-employment and random drug and alcohol testing on drivers of for-hire vehicles with capacity for 10 or more occupants, in accordance with federal regulations (49 CFR Part 382)

Mandates that all such drivers be included in random testing pools and must submit to testing when selected

Prohibits motor carriers from requiring or permitting drivers to operate for-hire vehicles with 10+ occupant capacity if the driver appears to have consumed drugs, controlled substances, or intoxicating substances within the preceding 8 hours based on general appearance, conduct, or other substantiating evidence

Becomes effective 120 days after enactment, with the Commissioner of Motor Vehicles authorized to adopt rules and regulations immediately to implement the law
