S. 364 Summary

• Authorizes police officers to request breath tests and/or saliva swabs during field testing of drivers involved in accidents or traffic violations, in addition to existing breath test authority.

• Expands chemical test authorization to include saliva as an approved testing method alongside breath, blood, and urine tests for determining alcohol and drug content.

• Allows police officers trained as drug recognition experts or who completed federal advanced roadside impaired driving enforcement training to establish reasonable cause for compulsory chemical tests based on observed drug impairment.

• Adds saliva swabs as evidence that can establish reasonable cause for obtaining court-ordered compulsory chemical tests in cases involving serious injury or death.

• Takes effect November 1 following enactment into law.
