Amends Penal Law Section 156.35 to clarify that criminal possession of computer related material in the second degree is a class E felony, with gender-neutral language updates.

Creates new Penal Law Section 156.36 establishing criminal possession of computer related material in the first degree as a class B felony.

First degree offense applies when unauthorized computer use under Section 156.05 is followed by knowing possession of illegally copied computer data or programs with intent to benefit oneself or others, causing financial harm exceeding $100,000.

Takes effect on November 1st following enactment into law.
