Permits issued by the Department of Environmental Conservation for public supply wells accessing a sole source aquifer in counties with 2 million or more residents are deemed invalid if the well has not been used for water withdrawal and public supply for over two years.

Wells inactive for over two years shall be classified as abandoned.

Before reissuing or renewing any such permit for water withdrawal, the Department must conduct a full review under the State Environmental Quality Review Act.

Permits that have not been renewed or reissued following this review are deemed invalid upon the bill's effective date in 2017.

The act takes effect immediately and applies to any public supply well meeting the inactive criteria on the effective date.
