NY S04008

Adds new section 389 to Vehicle and Traffic Law providing civil liability immunity for persons who forcibly enter a locked motor vehicle to remove an unsupervised or unattended child under age 8 in an emergency.

Requires the person to act reasonably and in good faith, determine the vehicle is locked with no other reasonable method to remove the child, and have reasonable belief the child faces imminent danger requiring immediate removal.

Mandates the person use no more force than reasonably necessary to enter the vehicle and remove the child.

Requires the person to contact local law enforcement, fire department, or 911 prior to forcible entry or as soon as reasonably practicable, remain with the child in a safe location near the vehicle, and immediately deliver the child to emergency responders upon arrival.

Takes effect immediately upon enactment.
