Operators of assisted living residences must provide written notice to the department's regional office prior to closure or decertification, including a commissioner-approved plan with specific timetables.

Closure plans must describe procedures for notifying residents and their representatives, assessing individual resident needs, assisting with relocation to alternative settings, and maintaining compliance until all residents have transferred.

Operators cannot close facilities or increase resident fees/surcharges until the commissioner approves the closure plan, and cannot accept new residents after notifying the department of intent to close.

Target closure date must be at least 120 days from written notification to residents, with extensions available for residents making good faith relocation efforts with reasonable cause for additional time.

Violations including failure to notify the department, failure to submit or execute an approved closure plan, or closing before all residents relocate result in civil penalties under existing law.
