NY S05900

Adds a new definition of "mentally disabled" to the Penal Law as a mental disease, defect, or condition that renders a person incapable of appraising the nature of conduct constituting taking, obtaining, or withholding of property.

Establishes that it is not a valid defense to larceny prosecution that the defendant obtained consent to take, withhold, or obtain property if that consent was obtained from a person the defendant knew or had reason to know was mentally disabled.

Takes effect immediately upon enactment.
