S. 6277--A: New York Land-Home Property Act

• Establishes a statewide procedure allowing manufactured homes affixed to permanent foundations to be conveyed and encumbered as real property rather than personal property, effective January 1, 2020.

• Requires owners to record an "affidavit of affixation" with the county recording officer when a manufactured home is permanently attached to real property with a permanent foundation and connected to residential utilities.

• Allows owners to surrender manufacturer's certificates of origin or vehicle titles to the Department of Motor Vehicles through applications, converting the manufactured home from personal property status to real property status once all requirements are satisfied.

• Provides a procedure for "confirmation of conversion" when manufactured homes lack or cannot produce existing certificates of title or manufacturer's certificates of origin.

• Allows manufactured homes previously converted to real property to be reconverted to personal property by recording an "affidavit of severance" when the home is detached from the real property, enabling reissuance of vehicle titles by the Commissioner of Motor Vehicles.
