Governor must submit five-year capital plans for SUNY state-operated campuses and CUNY senior colleges to the legislature as part of the annual executive budget, beginning fiscal year 2019 and every fifth fiscal year thereafter.

Capital plans shall provide for annual appropriation of capital funds to cover 100 percent of critical maintenance needs identified by each university system.

Plans may include funds for new infrastructure or major capital initiatives, but such funding does not count toward meeting the 100 percent critical maintenance requirement.

If funding limitations prevent covering 100 percent of critical maintenance needs, the director of the budget shall develop plans designed to annually reduce the facility condition index (FCI) for each university system.

Director of the budget shall develop an apportionment methodology in consultation with SUNY and CUNY to distribute capital appropriations to individual campuses and colleges.
