Requires covered retail establishments (stores with at least 10,000 square feet or chains of three or more stores under common ownership) to contract with charitable or nonprofit organizations to donate all apparently consumable food and farm products.

Prohibits intentional contamination or spoilage of consumable farm or food products by food service establishments and retail food sellers, with violations punishable by fines up to $4,000.

Mandates covered retail establishments contract with waste collection entities to collect and compost all non-toxic organic waste, including damaged canned goods and spoiled food unsuitable for human consumption.

Establishes the New York State Excess Food Fund, jointly administered by the Commissioner of Agriculture and Markets and the State Comptroller, to be funded by fines collected from violations and used for administrative and enforcement costs.

Takes effect 120 days after becoming law, with authority to adopt necessary rules and regulations immediately upon enactment.
