Prohibits any person from selling, offering for sale, or distributing flavored e-liquid or e-cigarettes containing flavored e-liquid in New York State.

Defines "flavored e-liquid" as liquid containing nicotine sold for use in electronic cigarettes with natural or artificial additives that create a characterizing flavor.

Excludes tobacco and menthol flavors from the prohibition; includes fruit, chocolate, vanilla, honey, candy, cocoa, dessert, alcoholic beverage, herb, and spice flavorings.

Imposes fines of up to $100 per individual package for non-manufacturers who violate the law and up to $50,000 civil penalties per brand for manufacturers found in violation more than once within a 30-day period.

Provides manufacturers an affirmative defense if the sale occurred without their knowledge, consent, authorization, or direct/indirect involvement.
