Adds Section 66-p to Public Service Law requiring the Public Service Commission to establish modifications to existing programs encouraging qualified fuel cell electric generating systems by January 1, 2020.

Requires minimum annual expenditures of $50 million for the program commencing in calendar year 2020 and sustained through 2030, administered by the New York State Energy Research and Development Authority.

Defines qualified fuel cell electric generating systems as systems based on solid oxide, molten carbonate, proton exchange membrane, or phosphoric acid fuel cells manufactured and operated in accordance with applicable government and industry standards.

Establishes program requirements including incentive structures (competitive procurements, standing-offers, or production/capacity incentives), consideration of economic benefits to New York State, and minimization of peak load in constrained areas.

Adds Section 1020-jj to Public Authorities Law requiring the authority to implement a fuel cell incentive program with minimum annual expenditures of $15 million from 2020 through 2030 for systems installed after January 1, 2020.
