Allows the United States Department of Defense to appoint an eighth non-voting ad hoc member to the New York state board on electric generation siting and the environment when a proposed facility is located within 75 miles of an in-state military base.

Requires the board chair to notify the Department of Defense and the commander or senior military officer of the affected in-state military base when a pre-application preliminary scoping statement is received for a facility within 75 miles of a military base.

Grants the Department of Defense 45 days to appoint its ad hoc member, after which their right to appoint shall be deemed waived if no appointment is made.

Changes the requirement from "both" to "one or more" ad hoc public members not being appointed to allow a majority of named board members to constitute a quorum within 45 days.

Takes effect immediately and applies to all applications for a certificate filed on or after the effective date.
