Amends the definition of "unlawful use or administration of a controlled substance" to create an exception allowing custodians to administer medical marihuana in accordance with Public Health Law Article 33 and applicable state regulations and policies.

Requires facilities and provider agencies serving people with special needs to establish incident review committees composed of staff, healthcare practitioners, service recipients, and advocacy representatives to review reportable incidents and recommend improvements.

Mandates that facilities and provider agencies develop and implement safe storage, administration, and diversion prevention policies specifically for controlled substances and medical marihuana.

Takes effect 180 days after enactment, with authority granted to state agencies to promulgate necessary rules and regulations immediately upon passage.
