Amends Highway Law Section 10(24-e) and Transportation Corporations Law Section 7 to prohibit fees for fiber optic utility use and occupancy of state rights of way, changing prior language that allowed fees up to fair market value.

Removes provisions that exempted New York Broadband Program grant recipients from fees and that prohibited utilities from passing through state fees to customers.

Eliminates requirement that state compensation from such agreements be deposited into the dedicated highway and bridge trust fund.

Preserves municipal authority to regulate zoning, land use, and other local powers, with "municipality" defined to include counties, cities, villages, and towns.

Takes effect immediately, with provisions deemed repealed if the underlying statutory sections are repealed.
