Requires the New York Department of Health Commissioner to mandate residential health care facilities establish and implement infection control cohorting plans or procedures as part of their pandemic emergency plans.

Establishes minimum standards for cohort area policies and procedures that the Commissioner must inspect and evaluate at all residential health care facilities.

Allows facilities unable to meet the minimum cohorting standards to request a waiver from the Commissioner, which may be approved if the facility cannot establish such policies.

Subjects residential health care facilities with unapproved cohorting policies that do not receive a waiver to penalties determined by the Commissioner, including potential license suspension or contingent state reimbursements.

Takes effect immediately upon enactment.
