Defines "flamethrower" as a device capable of projecting a stream of burning fuel at least three feet, excluding inoperable display units.

Establishes criminal possession of a flamethrower as a class E felony under new Penal Law § 265.41.

Exempts historical flamethrowers (those constructed with at least five significant components manufactured before 1966), flamethrowers used for agricultural or construction purposes, and flamethrowers lawfully acquired before the law's effective date.

Permits manufacture, remanufacture, restoration, or alteration of flamethrower components.

Takes effect 120 days after becoming law.
