Creates two new felonies under Penal Law: failure to obtain a building permit or certificate of occupancy for a dwelling in the second degree (Class E felony) and first degree (Class D felony).

Applies only to one to four family dwellings in cities with a population of one million or more where the owner authorized illegal alterations that violated building code or local law.

Second degree felony requires physical injury to a person caused directly or indirectly by the illegal alterations, either from failure to obtain an alteration permit or failure to obtain a certificate of occupancy before allowing occupation.

First degree felony requires serious physical injury to a person caused directly or indirectly by the illegal alterations, with the same permit and occupancy violation requirements as second degree.

Takes effect 60 days after becoming law.
