S. 6040 Summary

• Creates a new licensing system for hemp growers, extractors, and product manufacturers who cultivate or process hemp for cannabinoid content, with licenses valid for three years and renewable.

• Establishes application requirements including proof of good moral character, fingerprinting, farm income of at least $10,000 from agricultural products, majority New York state ownership, and active participation in farm operations.

• Allows hemp-derived beverages and food products with up to 20 milligrams of cannabidiol per serving to be sold without restriction, provided manufacturers comply with labeling and testing requirements.

• Requires independent laboratory testing for tetrahydrocannabinol (THC) compliance with a limit of 0.3 percent on a dry weight basis, along with testing for pesticides, heavy metals, yeast, and mold in all hemp products.

• Removes the term "industrial" from existing hemp statutes and establishes fees for applications, licenses, and monitoring while authorizing the Department of Agriculture to promulgate regulations and create a hemp workgroup for recommendations.
