S. 6184-A Summary

• Expands the definition of "industrial hemp" to include seeds, derivatives, extracts, cannabinoids, isomers, acids, and salts with delta-9-tetrahydrocannabinol concentration not exceeding 0.3 percent on a dry weight basis.

• Permits growth, production, possession, sale, distribution, and processing of industrial hemp and derived products in New York state pursuant to state law and federal authorization, removing restrictions on pilot program requirements.

• Establishes biennial licensing system requiring applicants to demonstrate good character, experience, competency, adequate facilities, equipment, process controls, testing capability, and security to grow industrial hemp.

• Creates new Article 29-A regulating hemp extract for human and animal consumption through three license types: cannabinoid grower, cannabinoid manufacturer, and cannabinoid extractor, with biennial fees set by the commissioner.

• Authorizes cannabinoid permits for retailers, wholesalers, and distributors; mandates independent laboratory testing; requires child-resistant packaging and labeling; prohibits pesticides on cannabinoid crops; and establishes penalties up to $10,000 for violations.
