Creates a new crime of "menacing a police officer or peace officer in the second degree" as a class E felony for intentionally assaulting an officer by throwing or spraying water or other substances while the officer is performing official duties.

Renames the existing menacing statute (§ 120.18) to specify "menacing a police officer or peace officer in the first degree," maintaining it as a class D felony for displaying a deadly weapon or firearm with intent to place an officer in fear of injury or death.

Adds menacing a police officer or peace officer in the second degree as a basis for arrest without a warrant under criminal procedure law § 150.20(1)(b)(viii)(ix).

Takes effect November 1 following enactment, or synchronized with the effective date of part JJJ of chapter 59 of the 2019 laws if that date has not yet occurred.
