Department of Health must develop an informational pamphlet on pelvic examinations by July 1, 2020, in coordination with the American College of Obstetricians and Gynecologists, Medical Society of the State of New York, and New York State Academy of Family Physicians.

Pamphlet must include information on what a pelvic exam is, privacy expectations (including provision of gown or drape), speculum use, glove requirements, other relevant exams, and a phone number for the Office of Professional Medical Conduct to report misconduct.

Pamphlet shall be written in layperson's language and available in both English and Spanish, distributed as a printable file and/or printed deliverable on the Department's website.

Medical practitioners must provide the pamphlet to patients before their first pelvic examination and obtain signed acknowledgment of receipt to be maintained in the patient's medical record.

Violations subject to administrative fines by the appropriate licensing board beginning on the second and subsequent complaints; no criminal penalties apply, and collected fines must be appropriated by the legislature before expenditure.
