Program sponsors may adjust the "participation in department responses" point system category when adopting written emergency response protocols that restrict certain fire department personnel from responding to non-emergency and/or emergency calls based on district physician determinations.

Participants in different response groups must meet the minimum number of emergency calls assigned to their specific group using the applicable percentage from the existing point system.

Point system amendments addressing written emergency response protocols may be adopted by 60% affirmative vote of the governing board, without requiring a referendum (unlike the standard process under section 216).

Amendments take effect January 1st of the following year after adoption proceedings are completed, applying prospectively only, unless the new protocol addresses a state disaster emergency declared under Executive Law section 20, in which case the amendment may apply in the year adopted.

Act takes effect immediately upon enactment.
