Amends Penal Law Section 125.27 to add a new circumstance constituting murder in the first degree when a victim is killed during the commission or attempted commission of a drive-by shooting.

Defines "drive-by shooting" as when a person intentionally discharges a firearm from a motor vehicle at another person outside that vehicle with intent to cause death.

Motor vehicle is defined by reference to Vehicle and Traffic Law Section 125.

Takes effect immediately upon enactment.
