Amends Penal Law Section 145.05 (criminal mischief in the third degree) to add a new provision making it a crime to damage property owned, controlled, leased or utilized by a municipality, town, village or public authority that results in the property being taken out of service for repairs.

Amends Penal Law Section 145.10 (criminal mischief in the second degree, a class D felony) to add a provision for damaging municipal or public authority property that is taken out of service and exceeds $250 in damages.

Amends Penal Law Section 145.12 (criminal mischief in the first degree, a class B felony) to add a provision for damaging municipal or public authority property that is taken out of service and exceeds $1,500 in damages.

Updates gender-neutral language throughout the statute by replacing "he" with "he or she."

Takes effect 90 days after becoming law.
