NY S09018

Creates a new crime of unlawful dissemination or publication of discovery material in Penal Law § 215.09, classified as a class E felony.

Makes it unlawful to intentionally disseminate or publish discovery material with intent to intimidate or harass another person, or to knowingly provide such material to someone who intends to use it for intimidation or harassment.

Exempts defense counsel from liability under the statute when communicating directly with their defendant client in accordance with criminal procedure law article 245.

Adds unlawful dissemination or publication of discovery material as a qualifying offense for detention decisions under Criminal Procedure Law §§ 510.10, 530.20, and 530.40.

Takes effect immediately upon enactment.
