Requires licensees performing inpatient and/or outpatient surgical care to notify patients by telephone, email, or text message at the time of approval if all or part of an approved surgical procedure will be rendered by an out-of-network provider.

Mandates written confirmation of out-of-network provider notification be sent by mail within twenty-four hours of surgical procedure approval.

Requires the licensee or hospital to cover the full cost of the procedure as though services were provided in-network if notice is not given to the patient at least forty-eight hours before the procedure.

Exempts emergency surgical procedures performed within twenty-four hours of a patient sustaining an injury from these notification requirements.

Takes effect ninety days after becoming law.
