Requires the Department of Transportation to create rules and regulations, in consultation with the Department of Environmental Conservation, mandating environmental impact statements for any entity proposing construction of a new building development within one mile of a transit facility.

Environmental impact statements must comply with Article 8 of the Environmental Conservation Law and include a thorough investigation of underground environmental impacts, including soil toxicity, effects of geo-energy exploitation (fracking and shale gas transmission), geothermal energy generation, and carbon dioxide sequestration.

Defines "building development" as the proposed construction of a road or structure.

Defines "transit facility" to include rapid transit railroads, omnibus lines, railroads used for passenger or mail transport, airports, bus terminals, ferry terminals, and other mass transportation structures operated by the metropolitan transit authority, New York City Transit Authority, and Port Authority of New York and New Jersey.

Takes effect immediately upon enactment.
