S. 9114 Summary: COVID-19 Emergency Eviction and Foreclosure Prevention Act of 2020

• Eviction Protection: Tenants who submit a hardship declaration cannot be evicted for nonpayment of rent or lease expiration until at least May 1, 2021, except for persistent lease violations causing safety hazards; all pending eviction proceedings are stayed for at least 60 days.

• Foreclosure Protection: Homeowners with 10 or fewer residential dwelling units who submit a hardship declaration cannot face mortgage foreclosure until at least May 1, 2021; all pending foreclosure actions are stayed for at least 60 days.

• Tax Foreclosure Protection: Property owners facing tax lien sales or tax foreclosures can submit a hardship declaration to stay all such proceedings until May 1, 2021; statutes of limitation for tax actions are tolled during the stay.

• Credit Protection: Lending institutions cannot discriminate in credit decisions or negatively report to credit agencies owners who have received foreclosure stays or filed hardship declarations due to COVID-19 financial hardship.

• Tax Exemption Renewal: Local assessors must automatically renew senior and disabled person property tax exemptions from the 2020 assessment roll to the 2021 roll without requiring renewal applications; all provisions expire May 1, 2021.
