Prohibits courts from granting physical or legal custody of, or unsupervised visitation with, a child to sex offenders designated as sexual predators, sexually violent offenders, or classified as level two or three risk for crimes involving a child, except in extraordinary circumstances.

Creates a presumption that level two or three risk sex offenders are ineligible for physical or legal custody of, or unsupervised visitation with, a child, requiring the offender to provide clear and convincing evidence that such custody or visitation serves the best interest of the child.

Reletters existing Section 168-w of the Correction Law to Section 168-x and establishes new Section 168-w with these custody and visitation restrictions.

Takes effect on November 1 of the year following enactment.
