Adds section 716 to the Real Property Actions and Proceedings Law to prohibit removal of tenants from residential units based on certified medical use of medical marihuana as defined in Public Health Law section 3360.

Makes it a defense in eviction proceedings if a landlord seeks recovery of possession because of a tenant's certified medical marihuana use, unless the landlord can prove another lawful ground for eviction.

Preserves landlord's right to evict tenants on any other lawful grounds unrelated to certified medical marihuana use.

Takes effect immediately upon enactment.
