Landlords are prohibited from renting or leasing any property unless it complies with the New York State Uniform Fire Prevention and Building Code Act, specifically that utility services are made available to the dwelling.

Landlords who fail to comply with utility service requirements prior to renting or leasing a property face penalties under sections 145.15 and 145.20 of the penal law.

Landlords must participate in any voluntary program offered by utility companies that would keep utility services connected between tenants and revert utility accounts to the landlord's name.

The requirement to maintain utility services between tenants does not apply if the utility company in the property's area does not offer such a program.

The act takes effect immediately upon enactment.
