Amends Labor Law sections 652 and 653 to allow counties to opt out of wage increases for food service workers and service employees that eliminate the tip credit.

Preserves the existing two-thirds minimum wage requirement for tipped food service workers, provided tips combined with cash wage equal the statutory minimum wage.

Permits counties to decline implementation of wage orders that would increase cash wages in a way that removes the ability to use tip credits toward minimum wage compliance.

Applies the opt-out provision to both automatic minimum wage adjustments and wage board recommendations for food service worker wages.

Takes effect immediately upon enactment.
