Inmates serving indeterminate or determinate sentences shall automatically receive one-third time credit upon entry into the department's custody to encourage good behavior, with calculations and release dates provided within 30 days of incarceration.

All eligible inmates (excluding those serving sentences for class A-I felonies under sections 125.25, 125.26, and 125.27 of the penal law) shall earn one month of additional sentence credit for each month of participation in approved programs including education, vocational training, substance abuse treatment, work assignments, and rehabilitative activities.

Inmates participating in merit programs shall also earn expanded privileges including phone access, video conferencing, visiting privileges, commissary benefits, email time, and unit transfer consideration.

Accrued time credits cannot be forfeited if an inmate is returned to custody for community supervision violations; inmates shall continue earning credits against remaining sentence portions.

Detainees awaiting trial or sentencing shall receive one additional day of credit for each day of participation in rehabilitation and job training programs.
