Allows Ryan Flaherty, a deputy sheriff employed by Orleans County since January 23, 2005, to participate in the 20-year retirement plan under Section 553 of the Retirement and Social Security Law instead of the 25-year plan he was enrolled in.

Requires that Flaherty failed to timely file an application for the 20-year plan through no fault of his own, and Orleans County must certify he did not bar himself from participation through negligence.

Orleans County has one year from the effective date to elect to assume costs by filing a resolution with the state comptroller; Flaherty has 18 months to elect coverage under Section 553.

All employer past service costs shall be borne by Orleans County and may be amortized over five years; estimated at approximately $143,000 as a one-time payment or $32,000 annually if amortized.

Takes effect immediately upon enactment.
